Preventing spam SMS in Australia

What do I need to know?

If you or your customers are interested in sending marketing messages to Australian numbers, you're required to comply with the Spam Act 2003, which prohibits the sending of unsolicited commercial electronic messages.

This includes but isn't limited to:

  • Offering goods or services for sale

  • Advertising or promoting goods or services

  • Advertising or promoting a business

  • Advertising or promoting any business opportunity or investment, etc

Who is responsible?

The person sending the commercial electronic message or authorizing the sending of such messages.

What do I need to do?

If your business considers sending or supporting your customers in sending advertising messages, we urge you to consider the following before sending messages to Australian numbers:

  • Collect and record consent from the recipients, whether expressed or inferred.

  • Identify the sender of the message through clear and accurate information, including contact details. This can either be your company details or your customers’ details depending on who is the actual sender of the message. For businesses, ACMA requires the message to include the business registration number of that company.

  • Include a functional "unsubscribe" feature at no cost and maintain operational processes to ensure it's actioned within 5 business days.
